Terms of Service

Welcome to Off The Rails Kustom Kreations ("OTRK," "we," "us," or "our"). By accessing our website at otrkustomkreations.com or placing an order, you agree to the following terms.

Products & Services

We are a custom laser engraving workshop in Somerset, Wisconsin. Our products include personalized plaques, signs, tumblers, cutting boards, coasters, and other laser engraved items. Every custom piece is made to order based on your specifications and approved proof.

Ordering Process

When you place an order for a personalized item, we create a digital proof for your review. You are responsible for verifying all text, spelling, dates, names, and design elements in your proof before approving. Once you approve the proof, production begins and the order cannot be modified or cancelled.

Orders for pre-designed items (no personalization) follow standard e-commerce terms and may be cancelled before shipment.

Custom & Personalized Orders

All personalized items are made to order and non-refundable once production begins. Production begins after you approve your digital proof. This policy exists because custom engraved items cannot be resold.

We will make every effort to match your approved proof exactly. Minor variations in wood grain, color, and natural material characteristics are normal and not considered defects. No two pieces of natural wood are identical.

Pricing & Payment

All prices are listed in US dollars. Prices are subject to change without notice, but any price changes will not affect orders already placed. Payment is due at the time of order. We accept all major credit cards through Shopify Payments.

Bulk & Corporate Orders

Orders of 10 or more units require a 50% deposit at the time of order. The remaining balance is due before shipping. Corporate, fundraising, and event orders may be subject to separate written agreements with additional terms.

Cancellation of bulk orders after proof approval may incur a restocking fee of up to 25% of the order total, reflecting materials and production time already invested.

Intellectual Property

You are responsible for ensuring you have the legal right to use any text, images, logos, designs, or artwork you submit for engraving. We reserve the right to refuse orders that may infringe on third-party trademarks, copyrights, or other intellectual property rights.

OTRK is not liable for any intellectual property disputes arising from customer-submitted content. By submitting content for engraving, you represent that you own the rights to that content or have obtained proper authorization to use it.

Product Images & Descriptions

We make every effort to display our products accurately. However, the appearance of products may vary slightly from photographs due to natural material variations, monitor settings, and lighting conditions. Wood grain, color, and texture will differ from piece to piece.

Limitation of Liability

OTRK's liability is limited to the purchase price of the product. We are not liable for indirect, incidental, or consequential damages arising from the use of our products or services.

Governing Law

These terms are governed by the laws of the State of Wisconsin. Any disputes will be resolved in the courts of St. Croix County, Wisconsin.

Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our website after changes constitutes acceptance of the updated terms.
